Who Must Implement It

The obligation to implement an internal reporting channel affects:
  • All public-sector entities.
  • Private-sector organisations with 50 or more employees.
  • Smaller private entities within regulated sectors (e.g. financial services, environmental protection, transport safety, etc.) when EU law applies.
  • Political parties, trade unions, employer associations, and foundations receiving or managing public funds.

Deadlines for Compliance

Generally, entities have three months from the law’s effective date (13 June 2023) to implement an internal system. For entities under 250 employees or municipalities under 10,000 inhabitants, the extended deadline is 1 December 2023.

Management & Optional Outsourcing

The organisation’s governing body (after consulting labour-representative bodies) must designate a “System Responsible” – often a senior executive – to oversee the channel. External management (outsourcing) is permitted and often advisable for impartiality.

  • Serious or very serious administrative infractions.
